These Terms of Service (“Terms”) form a binding agreement between you and DynamicCRM (“DynamicCRM,” “we,” “us”) governing your access to and use of our website, applications and services (the “Services”). By creating an account, accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization.
You must provide accurate information when creating an Account and keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your Account. Notify us promptly of any unauthorized use. You must be at least 18 years old and capable of forming a binding contract to use the Services.
You agree not to misuse the Services. In particular, you will not:
You retain all rights to your Customer Content. You grant us a limited license to host, process and display Customer Content solely to provide and improve the Services. You are responsible for the accuracy and legality of Customer Content and for having the necessary rights to submit it. Our handling of personal data is described in our Privacy Policy, and you can request deletion via our Data Deletion page.
The Services, including all software, design, text, graphics and trademarks, are owned by DynamicCRM or its licensors and are protected by intellectual-property laws. Except for the limited rights expressly granted to you, we reserve all rights. You may not use our branding without our prior written permission.
The Services may integrate with or link to third-party products. Those products are governed by their own terms and privacy policies, and we are not responsible for them. Your use of an integration is at your own discretion and risk.
The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or completely secure.
To the maximum extent permitted by law, DynamicCRM will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill. Our total liability arising out of or relating to these Terms or the Services will not exceed the amounts you paid to us for the Services in the twelve months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless DynamicCRM and its affiliates from any claims, damages, liabilities and expenses arising out of your Customer Content, your use of the Services, or your violation of these Terms or applicable law.
These Terms remain in effect while you use the Services. You may cancel at any time through your Account settings. We may suspend or terminate access if you breach these Terms or if necessary to protect the Services or other users. Upon termination, your right to use the Services ends, and we may delete Customer Content after a reasonable retention period, subject to applicable law.
We may modify the Services or these Terms from time to time. When changes are material, we will provide notice — for example, by posting an updated version with a new “Last updated” date or by notifying you in-app. Your continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the courts located in Denver, Colorado, except where applicable law provides otherwise. Nothing in this section limits any mandatory consumer-protection rights you may have.
